Abuse of Authority by State Agency?

CYFD (Child Protection) in NM has stated that they cannot give custody of a child, that only a district court judge order can-I have a temporary court order which CYFD and the father ignored. I called a higher supervisor who said that it is true that CYFD cannot decided custody issues. CYFD told the father that they will testify for him for free but if I wanted the same thing I have to subpoena them and pay a $95 fee-they also made the claim to the local city police that the father was given full custody of the baby by the judge but there is no such order-would that not be abusing their authority and leave them to perjury-father caught using child's name and SSN for employment purposes and company HR going to take action.
